1. Acceptance of Terms
By accessing or using any services provided by Rustam Infotech Pvt. Ltd. (including EduTrack, MedTrack, BizSync, IoT hardware, and custom software development), you agree to be bound by these Terms and Conditions. If you do not agree, you must discontinue service usage immediately.
2. Software Licensing & Usage
- License Grant: Rustam Infotech Pvt. Ltd. grants clients a non-exclusive, non-transferable, limited license to access and use our software platforms (SaaS/On-Premises) as agreed upon in the service contract.
- Restrictions: Clients shall not reverse-engineer, decompile, copy, modify, resell, or distribute the source code or proprietary architecture of any software product.
- Uptime & Maintenance: While we aim for 99.9% platform availability, scheduled server maintenance and system upgrades may cause temporary interruptions with prior notification.
3. Hardware & IoT Deployment
For biometric, face recognition, and access control hardware deployments:
- Hardware warranties are subject to manufacturer terms provided at installation.
- Rustam Infotech Pvt. Ltd. is not responsible for hardware damages resulting from unauthorized tampering, power surges, or environmental damage.
4. Payments, Subscriptions & Taxes
- Software subscription fees (SaaS) are billed according to agreed monthly, quarterly, or annual billing cycles.
- Failure to clear outstanding invoices within 15 days of the due date may result in temporary suspension of software access.
- All charges are subject to applicable GST and statutory taxes under Indian law.
5. Limitation of Liability & Jurisdiction
Rustam Infotech Pvt. Ltd. shall not be liable for indirect, incidental, or consequential damages arising from system downtime, internet outages, or third-party service failures. Any legal disputes arising under these terms shall fall exclusively under the jurisdiction of the courts in Jhansi, Uttar Pradesh, India.
